Privacy Policy
How Retainerly handles personal information collected through this website, enquiries and specialist-operator applications.
Last updated:
1. Who is responsible for your information
Retainerly provides information about managed AI and automation infrastructure services for Australian businesses. This website is operated by Wesley Harrington Smith (ABN 88 761 784 317), an Australian sole trader using the Retainerly brand.
For website enquiries, privacy enquiries and complaints, email contact@retainerly.ai. The nominated privacy contact is the Retainerly Privacy Contact (the website operator).
Postal enquiries: Wesley Harrington Smith (Retainerly Privacy Contact), Suite 49016, PO Box 16, Nobby Beach QLD 4218, Australia. This is a postal correspondence address, not a claim about Retainerly's physical office or registered office.
This policy covers personal information handled through our website and initial business, specialist-operator and general enquiries, including related correspondence. Separate formal application or business-discovery forms may collect additional information, explained at the point of collection. If a later assessment or service requires additional information or different handling arrangements, we will explain those arrangements when requesting that information.
2. Information we collect
When you use our website enquiry form, we collect your name, email address, enquiry category and message, and your company if you choose to provide it. We also receive information you choose to send by email or during related discussions.
If you complete a separate specialist application or business-discovery form, we may collect the information requested in that form, such as business details, relevant operational requirements, professional qualifications, experience, areas of expertise, availability and responses to assessment questions. Any form-specific privacy notice will provide further details when applicable.
Our website and its providers process technical information for site delivery, security and usage measurement. This can include IP addresses, request times, browser and device information, pages visited, referral information and approximate location. The enquiry process also uses submission identifiers and timing information to manage requests and help prevent abuse.
Please provide only information relevant to your enquiry. Do not send passwords, API keys, identity documents, sensitive health information or identifiable customer records through the general enquiry form. Use anonymised examples where practical, and provide information about another person only where you are authorised to do so.
3. How we collect it and your choices
We generally collect enquiry information directly from you, including via website forms, email and discussions. Technical information is generated when your browser interacts with the website and its hosting, analytics and security services.
You can browse without submitting an enquiry. You may contact us anonymously or using a pseudonym where practical, although we need enough relevant information and a way to contact you to respond meaningfully. The website form marks required fields; optional fields may be left blank. If we cannot identify or contact you, we may be unable to progress your request.
4. Why we use information
We use relevant information to respond to enquiries, understand business needs, consider expressions of interest and applications from specialists, communicate about the matters you raise, maintain enquiry and application records, understand website usage, protect our systems and meet applicable legal obligations.
Submitting an enquiry does not give blanket consent to unrelated marketing. Any separate marketing communications must meet applicable consent, sender-identification and unsubscribe requirements.
5. Service providers and disclosures
Third-party service providers support our website and enquiry handling. The relevant services currently identified include:
- Vercel: website hosting, web analytics and technical security or anti-abuse functions (including BotID where enabled).
- Resend: sending website enquiry messages to our business email inbox where the contact-form integration is active.
- Google Workspace (including Gmail and Google Forms): handling business correspondence and, when used, collecting or storing information supplied through separate business-discovery and specialist-application forms.
Relevant information may be handled by these providers and their supporting service providers to perform those functions. We may also disclose relevant information to authorised people assisting with your enquiry, professional advisers where necessary, or where required or authorised by law. Any later service involving additional recipients or data will be addressed through the relevant privacy information and arrangements. Information may be processed or accessed outside Australia as explained in Section 6.
Analytics and similar technologies
The website uses analytics to understand aggregate website usage. Vercel describes its Web Analytics service as not relying on third-party cookies; this does not mean every security feature or external service is cookie-free. Automated-abuse checks may process browser challenge information or other signals depending on configuration.
You can manage cookies and similar technologies through your browser settings. Blocking scripts or storage may affect website functionality or security checks and does not necessarily prevent all server-side request logging.
6. Overseas processing
We use third-party service providers for website hosting, email delivery, security, analytics and business administration. Depending on their infrastructure and processing arrangements, personal information may be stored, processed or accessed outside Australia, including in the United States.
Other countries may also be involved depending on the services used and their supporting providers. We take applicable Australian privacy obligations into account when handling personal information through overseas service providers.
You can contact contact@retainerly.ai with questions about how your personal information is handled overseas.
7. Security
The website uses HTTPS and automated abuse checks. These measures help protect website communications and the enquiry channel, but no internet transmission or storage method is completely secure. Other security practices will depend on the actual systems and procedures in use.
Please contact contact@retainerly.ai if you believe information has been sent to us in error or exposed. We will assess reported concerns and take steps required by applicable law. Do not send additional sensitive information when reporting a concern unless an appropriate channel has been arranged.
8. Retention and deletion
The period for retaining information depends on why it is held, whether an enquiry or application remains active, and applicable legal, recordkeeping or dispute requirements. Provider logs and backup copies may have separate retention cycles.
You may ask us to delete information that is no longer needed. We will assess the request, including any lawful reason for retaining particular records, and explain relevant limitations. We do not promise immediate removal from every provider backup or unconditional deletion of records that must lawfully be kept.
9. Access and correction
Contact the Retainerly Privacy Contact at contact@retainerly.ai, or by post using the address in Section 1, to ask about personal information we hold about you or to request access or correction. We may need proportionate evidence of identity before releasing or changing records.
We will consider your request under applicable law, explain any lawful limitation and communicate the expected response timing. Applicable legal requirements take priority. If we cannot provide access or make a requested correction, we will explain why where legally permitted and identify available complaint options.
10. Complaints
Please send privacy concerns to contact@retainerly.ai, describing what happened and the outcome you seek. We will review the concern, communicate with you about its progress and provide a response within a reasonable period, subject to applicable legal requirements.
If you remain dissatisfied, you may contact the Office of the Australian Information Commissioner where the matter falls within its jurisdiction: oaic.gov.au/privacy/privacy-complaints (opens in a new tab). Other legal complaint or review rights are not limited by this policy.
11. Updates
We will update the displayed date when the policy materially changes, including when our legal operator or relevant information-handling practices change. A later policy does not by itself authorise a new use or disclosure of previously collected information where another notice, consent or legal basis is required.
